- What these terms cover. These are the terms and conditions on which we supply services to you.
- Why you should read them. Please read these terms carefully. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
- Information about us and how to contact us
- Who we are. We are Airfield Active Limited (Trading as the Airfield Active) registered number NI679495, established in Northern Ireland. Our address is 62B Airfield Road, Toomebridge, Co.Antrim.
- How to contact us. You can contact us by telephoning 028 7965 9332 or 07902 170711 or by writing to us at [email protected].
- How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us. We will not share these details or information with any third parties or persons outside of Airfield Active and any information on you is destroyed if you end your membership with us.
- Definitions and Interpretation
- In these conditions (unless the context otherwise requires):
- “Application Form” means the form you filled in (containing these Conditions on the back) when applying for membership or long term programmes to Airfield Active and which forms part of the Membership Agreement;
- “Business Day” means Monday to Thursday 7 am to 9 pm, Friday 7 am to 6 pm and Saturday 9 am to 2 pm. However as Airfield Active is a class based gym, we are not necessarily always going to be open to the public for the whole duration of this time;
- “The Airfield Active Manager” means Thomas Corr and Sean Corr;
- “Conditions” means these terms and conditions of membership of Airfield Active;
- “Facilities” includes (but are not restricted to) the personal training centre, changing rooms and other facilities provided by Airfield Active from time to time at the Premises;
- “Membership” means the rights, privileges and obligations of a Monthly Member and/ or any Members signed onto programmes, courses or session packages provided by Airfield Active and/or NJR Performance;
- “Membership Agreement” means the agreement between you and Airfield Active governing Membership of Airfield Active which contains these Conditions and Rules and Regulations;
- “Membership Date” means the date on which Airfield Active receive your first monthly payment or payment to a programme or course;
- “Membership Subscription” means your monthly payment or programme payment in respect of your Membership as agreed;
- “Monthly Member” means a person over the age of 16 years who has entered into a Membership Agreement with Airfield Active and who has subscribed for the services for a minimum of six months
- “Member” means a person over the age of 16 years who has entered into a Membership by subscription onto a programme or course;
- “Premises” means Airfield Active’s premises at Airfield Active,62B Airfield Road, Toomebridge, Co.Antrim, but not restricted to, the car parking area;
- “Rules and Regulations” means the rules and regulations of Airfield Active in force from time to time forming part of the Membership Agreement and governing the use of Airfield Active.
- “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
- Joining
- By signing this Agreement you are agreeing to pay the Membership Subscription and complying with these Conditions and the Rules and Regulations.
- Your Membership will begin on the date these payments have been received by Airfield Active and will continue for a minimum period of 4 or 8 weeks (dependant upon which contract you have agreed to and entered) and thereafter will continue on another similar contract until it is cancelled by you in writing upon 30 days’ written notice at the end of your term, or it is terminated by Airfield Active.
- Monthly Members will be provided with a Membership online account that they must use to book sessions every time they train. Any bookings that can no longer be attended must be cancelled in advance using the online booking system, no later than 3 hours prior to the class start time. 4. In the case of failure to book a membership or session, and membership cannot be proven, then Airfield Active has the right to refuse you taking part in the training session.
- Monthly Membership
- Your membership entitles you to attend all group sessions if you have the unlimited option, or 2 sessions per week with the limited option.
- Monthly Subscription is paid by recurring card payments via Glofox Secure Payments online payment gateway. Payment details are stored securely by Glofox and adhere to the Data Protection Act rules and regulations. Airfield Active does not keep any other record of your payment details. You must supply the card details of an account that you are happy for regular monthly payments to be taken from.
- Subject to clause 6.4, your Membership Subscription shall be payable during the term of your Membership irrespective of your actual usage of Airfield Active or change in personal circumstances.
- Monthly Membership runs from the first day to the last day of each month. Monthly Members signing up part way through a month are required to pay for each week left in that month (25% of the full amount per week).
- Monthly payments will be taken on the date of your first agreed purchase and you will receive notice two days prior.
- Should you fail to cancel a session that you can no longer attend, then this will be classed as ‘No show’. Should you fail to attend a booked session on three occasions within one calendar month, you will be penalised by a prevention of using the facilities for one week.
- Booking of two or more sessions per day including any waiting lists is not permitted
- Facilities
- Upon commencement of your Monthly Membership or Membership to a Programme you will be required to complete a Physical Activity Readiness Questionnaire (“PARQ“) before taking part in a fitness session.
- From time to time, Airfield Active may need to temporarily withdraw the use of all parts or certain parts of the Facilities for the purposes of maintenance, cleaning, repairing, upgrading and decorating, holidays or for reasons beyond the control of Airfield Active. Airfield Active will give reasonable notice of such withdrawals of use where this is practicable.
- In the case of bank holidays and national holidays, when training cannot take place due to the Facilities being closed, your Membership Subscription is non returnable or discountable. 4. If the Facilities remain unavailable to you for a period of more than 30 consecutive days:
- Provided that your Membership Subscription is paid monthly you will be entitled to a credit against your monthly Membership Subscription; or
- If your Membership Subscription is prepaid in advance each year you will be entitled to an extension of Membership equal to the period during which the Facilities were unavailable.
- Coaching
- All training and coaching shall be conducted by qualified coaches or personal trainers and or qualified instructors appointed by Airfield Active and NJR Performance.
- Cancellation of Membership or Programme by You
- You may cancel your Membership upon completion of the agreement of your Membership and upon 30 days’ written notice to Airfield Active at the end of that term.
- Termination of Membership by Airfield Active
- Airfield Active may suspend or terminate your Membership in the following circumstances:
- If you commit a serious or repeated breach of the Membership Agreement, these Conditions or the Rules and Regulations and the breach, if capable of remedy is not remedied within 7 days of receipt of notice explaining the breach;
- If any part of the Membership Subscription remains unpaid for 30 days after it is due; or
- If you provided Airfield Active with information which you knew to be false when applying for Membership and the false declaration would have affected Airfield Active’s decision to grant you membership.
- If Airfield Active terminates for any of these reasons, it reserves the right to retain the remainder of the Membership Subscription of the month in which the Membership is terminated to cover any administration costs incurred as a result.
- Consequences of Cancellation or Termination
- Airfield Active will cancel the scheduled direct debit payment upon cancellation or termination of your Membership.
- Upon cancellation or termination of your Membership you must pay any fees that are due up to the date of the cancellation or termination.
- Liability
- Airfield Active do not exclude or limit in any way their liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by their negligence or the negligence of their employees, agents or subcontractors; or for fraud or fraudulent misrepresentation.
- Airfield Active accepts no liability for any loss or damage you may suffer if the failure is attributable to:
- The Member's fault;
- A third party unconnected with Airfield Active’s provision of services under this Agreement; or
- Events which neither Airfield Active nor its suppliers could have foreseen or forestalled even if they had taken all reasonable care.
- Airfield Active shall not be liable for loss of any money or personal items or loss or damage to your personal property whilst on the Premises.
- All Members must take responsibility for their own health and safety at all times. If Members are concerned with a potential injury or accident that may occur during training, then the Member must stop immediately and inform their trainer/instructor.
- Airfield Active cannot guarantee transformation results, weight loss, muscle gain or any other type of fitness benefit that it provides in its services. Airfield Active can only guarantee the quality of its consultation and work.
- Airfield Active's Rights
- If Airfield Active makes any concession to a Member or does not enforce any or all of its rights it shall not affect the rights of Airfield Active under the Membership Agreement and does not mean that Airfield Active has given up these rights.
- If there is a problem with the services
- If you have any questions or complaints about the services, please contact us. You can contact us by writing to us at [email protected]. Alternatively, please speak to one of our trainers at the Premises.
- How we may use your personal information
- Airfield Active will use the personal information you provide to:
- provide the services; and
- process your payment for such services.
- Airfield Active will only give your personal information to third parties where the law either requires or allows it to do so. 19. Airfield Active will use personal information which you provide to administer your Membership. Information about your physical health or condition which you provide in the PARQ form and which Airfield Active obtains during your Membership will be used by Airfield Active to assess your suitability for Airfield Active’s group personal training. In the event of a medical emergency, Airfield Active may need to seek information from or provide information to your doctor.
- Airfield Active may use your Membership information including how you use your Membership, to help develop goods and services which may be of interest to you. Airfield Active may inform you by post, e-mail or other reasonable methods about its offers or forthcoming events.
- Notices
- All notices to Airfield Active must be in writing and should be posted, emailed or delivered in person at the reception of the club. It is your responsibility that we receive your correspondence.
- All notices by Airfield Active to you shall be in writing and will be posted to the address contained in the Application Form or emailed to the email you provided in the Application Form. You will be deemed to have received such notice 3 days after the date of posting.
- You are required to give written notice to Airfield Active of any change of address or other relevant personal details referred to on Airfield Active’s membership Application Form. Failing such notice, all communications shall be assumed to have been received by the member within 7 days of mailing to the last address that was notified to Airfield Active.
- Changes to these Conditions
- From time to time, Airfield Active may need to make permanent amendments to these Conditions to ensure the health and safety of Members or for operational reasons. Such proposed amendments will be displayed in Airfield Active’s Premises for a period of 30 days before the amendments are made.
- Changes to these Conditions
- These Conditions shall apply to the Membership Agreement to the exclusion of any other terms and conditions contained or referred to in any letter, form of contract or other communication sent by the Member to Airfield Active and the provisions of these Conditions shall prevail.
- Nobody else has any rights under this contract. This contract is between you and Airfield Active. No other person shall have any rights to enforce any of its terms.
- No person who is not a party to the Membership Agreement, these Conditions and the Rules and Regulations is entitled to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
- If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- Even if Airfield Active delays in enforcing this contract, Airfield Active can still enforce it at a later date. If you have not agreed to these terms and conditions prior to you first availing of the services provided by Airfield Active it does not prevent Airfield Active taking steps against you at a later date, if terms and conditions are broken. For example, if you miss a payment but we continue to provide the services, we will still require you to make the payment at a later date.
- These terms are governed by British law and you can bring legal proceedings in respect of the services in the British and Northern Irish Law of courts.
- Rules and Regulations Overview
- Opening Times
- Details of opening times of Airfield Active are available on www.airfieldactive.co.uk and on all our various social media accounts and apps. Notice of significant variations to these times will be given by Airfield Active to its members.
- Conduct
- You must ensure that you are dressed appropriately to participate in the group personal classes;
- Your clothing must be suitable and appropriate clean training shoes must be worn. Unclean, wet or soiled footwear will be refused in the training area;
- You must show consideration to Airfield Active staff and the other Members and must not:
- Use foul or abusive language;
- Bring animals to any part of the Premises (unless the Member is a disabled person requiring the support of such animal);
- Smoke in any part of the Premises; or
- Bring, use, sell or be under the influence of illegal drugs or alcohol at the Premises.
- You must use the designated entrances when entering or exiting the Premises;
- Airfield Active use
- You must notify Airfield Active of any circumstances affecting your health, which may be exacerbated through participation in the group personal training classes;
- You must not use any piece of equipment without prior instruction. You must ask a member of Airfield Active staff about the correct method of operation of new or unfamiliar equipment.
- Classes and other events
- You must arrive 5 minutes before the commencement of the class you wish to attend and sign in using the barcode scanner at the front reception. Airfield Active management may prevent entrance to a class to anyone arriving after its commencement due to Health and Safety reasons.
- You are advised to book for the group personal training classes not less than 12 hours in advance of the start of the class.
- Other Facilities
- For security reasons, Members are advised to ensure all personal belongings are kept in the sight of the Member and the Member is advised not to leave any personal items unattended.
- Health and Hygiene
- The interests of health and hygiene all Members must:
- Never consume or store or bring into the changing rooms any food or drink or any kind of glass container;
- Never shave in the showers or sinks; and
- Not to attend the group personal training classes while under the influence of alcohol or anticoagulants, antihistamines, beta blockers, narcotics or tranquilisers.
- Airfield Active does not endorse the use of juice diets or any other form of weight loss produc
- Access to the clearly marked fire exits must remain clear at all times in the interests of safety.
- You must read the Health and Safety notices posted around Airfield Active’s premises.
- Smoking is not permitted in any part of Airfield Active’s premises.
- Facility Booking
- Bookings may be made for the group personal classes via online booking system (Airfield Active App)
- If you repeatedly fail to cancel a booking on three or more occasions within one month period, you will be refused bookings for one week. Continuation of failure to cancel booked sessions may result in Airfield Active terminating your contract.
